5G case: Juhi Chawla failed to pay ₹20 lakh
The Delhi State Legal Services Authority has filed a plea in the Delhi High Court seeking payment of a sum of 20 lakh rupees that was imposed on actor Juhi Chawla and others in connection with their petition regarding the deployment of 5G technology. The case has been rescheduled for February 3, according to reports. Juhi Chawla's lawyer claimed that he had not received a copy of the petition and that the actor had lately moved a division bench of the high court over the case. On January 25, the matter will be heard by a division bench.
Justice JR Midha dismissed Juhi Chawla's civil claim against the roll-out of 5G technology in India on June 4, 2021, and ordered the plaintiffs to pay a fee of Rs. 20 lakh. According to the court last year, the suit appears to be seeking publicity.
The actor recently appealed the ruling, claiming that the single bench order dismissing the suit was invalid in law since a matter can only be dismissed once the Court has authorized it to be registered as a suit.
The actor further stated that the single bench stated that her plea was solely for the purpose of gaining notoriety because she had disseminated the High Court's video-conferencing link on her social media accounts, resulting in the frequent disruption of the Court proceedings on June 4, 2021.
According to the plea, "More than 7 months have passed since this Hon'ble court had imposed cost upon Plaintiffs (Chawla and others), which was directed to be paid within seven days to DSLSA, but the Plaintiffs have failed to deposit the cost imposed by this Hon'ble Court."
In May of last year, a petition was filed in India opposing 5G, and the Bollywood star was one of the petitioners.
Justice JR Midha dismissed the lawsuit, saying it was "not maintainable" and "stuffed with unnecessary scandalous, frivolous, and vexatious averments" that were likely to be dismissed.
Because of the second wave of the covid epidemic, court procedures were held virtually at that time. Juhi Chawla joined the court proceedings through video conferencing, and the hearing was disrupted because she released the video connection on her social media sites.
Juhi Chawla issued a video after the case was dismissed, stating that she is not opposed to 5G technology. The actor stated at the time that the petition was just intended to get the government to clarify that 5G technology is safe.
The actress and other appellants argued in their appeal to the high court's division bench that the single judge dismissed the plea and levied costs without jurisdiction and in violation of established law.
It is stated that a plaint can only be dismissed once it has been granted permission to be filed as a lawsuit.
The appellants have also expressed their concerns about the negative effects of 5G technology, saying, "every day that the 5g trials are allowed to continue constitutes a distinct and imminent danger to the health of the people who reside in the vicinity of the area where the trials are being conducted."
The lawsuit requested that authorities certify to the general public that 5G technology is safe for humans, animals, and all other living organisms, plants and wildlife.
